Visitor / User
Visitors to Gulfjobseeker.com are granted a nonexclusive, limited license to
use and access the content and services offered in accordance with these Terms
and Conditions (the "License"). This website www.gulfjobseeker.com (hereinafter
referred to as "GJS") is owned, hosted and operated by First Impression Professional
Services, based in Ahmedabad, Gujarat, India (hereinafter referred to as "FIPS"),
and FIPS is advised and supported by FIMC a duly registered Management, Human
Resource and Market Research Consultancy based in Dubai, United Arab Emirates
under the official trade license issued by Department of Economic Development,
Dubai, U.A.E. Ownership of the database of GJS is vested exclusively with FIPS.
Rights of access and usage are subject to the compliance with the terms and
conditions set forth below. BY YOUR ACTS OF ACCESSING GJS, YOU AGREE TO BE BOUND
BY THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT AGREE WITH ANY OF
THESE TERMS AND CONDITIONS, YOU SHOULD NOT ACCESS OR USE GJS. IF YOU HAVE ANY

Amendments / Change / Update
FIPS may amend/modify these Terms and Conditions from time to time and such
modifications shall be effective immediately upon posting of the modified Terms
and Conditions on GJS website. You may review the modified Terms and Conditions
periodically to be aware of such modifications and your continued access or
use of GJS, shall be deemed conclusive proof of your acceptance of these Terms
and Conditions, as amended/modified from time to time. FIPS may also suspend
the operation GJS for support or technical up gradation, maintenance work, in
order to update the content or for any other reason. In a case of use of GJS
in a manner inconsistent with these Terms and Conditions, FIPS may terminate
your access, block your future access and/or seek such additional relief as
the circumstances of your misuse may be deemed to be fit and proper.
Definations
The term "misuse" shall mean and include all acts which are aimed at utilizing
the database of GJS for any purposes other than for searching and advertising
for genuine job vacancies. It shall also extend to the use of the database for
commercial purposes without the express permission of FIPS.
The term "offensive material" shall mean and include obscene material, it shall
include content which is aimed at demeaning a particular class of individuals,
corporate body, country etc. It shall also include content having the effect
of violating the Intellectual Property Rights of others.
The terms "service" or "services" would mean and include the interactive online
information service offered by GJS on the internet through which the user may
access information carried by GJS in the database maintained by it. The terms
would include the search tools through which the user can search through the
hosted databases and information using a number of search tools that are present
with a selection matching their search criteria. Users then select one or more
of the items presented to view the full document/ record. The term service does
not extend to GJS acting as an agent/consultant either express or implied on
behalf of any user/customer.
The term "Spamming" shall mean and include any unsolicited bulk e-mail or unsolicited
commercial e-mail.
The term "subscriber" would include any person, whether an individual or a legal
entity who has subscribed to the services of GJS, and to whom the access is
restricted by the use of a sign in user name and a password. The user name and
password are either allotted by GJS.
The term "unauthorised user" is defined as any person who does not have a legal
or a contractual right to access the services of GJS, but does so.
The terms "User" and "Customer" would include both the authorised and unauthorised
user(s).
Payment Terms
Payments for the services offered by GJS shall be on a 100% advance basis.
Refund in failed transactions.
Though FIPS payment reconciliation team works during work days, FIPS offers
no guarantees whatsoever for the accuracy or timeliness of the refunds reaching
the Customers card/bank accounts. This is on account of the multiplicity of
organizations involved in processing of online transactions, the problems with
Internet infrastructure currently available and working days/holidays of financial
institutions. Refunds in the event of wrong/objectionable content being posted
on the site would be at the discretion of FIPS. In case of no response or job
or interview calls FIPS will not refund the fee paid for its services, as it
dose not guarantees any kind of response, interview calls or response from employers
to job seekers except in CV Distribution Services, where it monitors all responses.
Credit Card Information
FIPS does not store or keep credit card data in a location that is accessible
via the Internet, neither it stores any data in its database. All credit card
transactions are handled by our merchant 2checkout.com and all credit card data
is encrypted and used only for legitimate purpose to process the payments for
our invoice against service provided. FIPS uses the maximum care as is possible
to ensure that all or any data / information in respect of electronic transfer
of money does not fall in the wrong hands and thats the reason we have SSL certificate
installed on our bankers servers to protect you against possible internet threat.
FIPS shall not be liable for any loss or damage sustained by reason of any disclosure
(inadvertent or otherwise) of any information concerning the user's account
and / or information relating to or regarding online transactions using credit
cards / debit cards and / or their verification process and particulars nor
for any error, omission or inaccuracy with respect to any information so disclosed
and used whether or not in pursuance of a legal process or otherwise by its
merchant Stripe.
Restriction / Prohibitions
You hereby expressly agree not to:
Use of the services of GJS in a manner contrary to the any law which might be applicable at the relevant time.
Access data not intended for you or log into server or account that you are not authorized to access;
Attempt to probe, scan or test the vulnerability of a system or network;
Attempt or breach security or authentication measures without proper authorization;
Attempt to interfere with, access to any other user including but not limited to by submitting a virus of any kind or Trojan horse to GJS, overloading, flooding, mail bombing or crashing;
Copy, distribute, download, display, perform, reproduce, modify, edit, alter, enhance, broadcast or tamper with in any way or otherwise use any material contained in GJS except as permitted;
Copy and distribute this information on any other server, or modify or re-use information, text, graphics, sound, etc. on this Website to any other system. No reproduction of any part of the Website may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or Website, whether in hard copy or electronic format, including postings to any other Website; or
Remove any copyright, trade mark or other intellectual property notices contained in the original material from any material copied or printed off from GJS or link to GJS, without our express written consent.
Providing deep links into GJS without prior permission of FIPS is prohibited. Extracting data from GJS using any automated process such as spiders, crawlers etc. or through any manual process for a purpose which has not been authorised in writing.
Upload, post, email, transmit or otherwise make available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.
Posting/uploading of offensive material on GJS is strictly prohibited.
Subscribers shall under no circumstance sublicense, assign, or transfer the License, and any attempt at such sublicense, assignment or transfer is void.
Post Wrong/false/misleading information on GJS.
Post Wrong/false/misleading information through resume or use dummy resume for stealing employer information.
Spamming is prohibited
FIPS reserves the right to filter and monitor and block the emails sent by you/user using the servers owned/maintained by FIPS to relay emails. All attempts shall be made by FIPS and the user to abide by International Best Practices in containing and eliminating Spam. Violations of system or network security may result in civil or criminal liability as per the applicable law.
Links to third party websites
GJS may provide links to other third-party World Wide Web sites or resources. FIPS makes no representations whatsoever about any other Web site you may access through this Website (GJS).
Disclaimer
The content of GJS is provided "as is" and on an "as available" basis, without
warranties or representations of any kind, either express or implied. FIPS and
any third party providing materials, services or content to this website, disclaims
all warranties, express or implied, statutory or otherwise including, but not
limited to, implied warranties of merchantability, fitness for a particular
purpose, non-infringement of third party rights, completeness or accuracy of
the information, update or correctness of the information, freedom from computer
viruses, other violation of rights regarding services, products, material and
contents of GJS. It is solely your responsibility to evaluate the accuracy,
completeness and usefulness of all opinions, advice, services, merchandise and
other information provided through the Website. FIPS does not warrant that the
access to Website will be uninterrupted or error-free or that defects in Website
will be corrected. No information contained herein shall constitute an invitation
or an offer to invest in FIPS or any of its Affiliates. Further, nothing contained

shall not be responsible for any problem or technical malfunction on-line-systems,
servers or providers, computer equipment, software, failure of e-mail or players
on account of technical problem or traffic congestion on the Internet or at
any website or combination thereof, including injury or damage to any customer
and/or Members or to any other persons computer related to or resulting from
participating or downloading materials/information from the website.
Termination
FIPS may, without notice in its sole discretion, and at any time, terminate
or restrict your use or access to GJS (or any part thereof) for any reason,
including, without limitation, that FIPS based on its judgment and perception
believes you have violated or acted inconsistently with the letter or spirit
of these Terms and Conditions ( License) and holds the right to block your IP
address and access to its website.
Indemnification
Submissions and unauthorized use of any information(s)/materials contained on
GJS may violate copyright laws, trademark laws, the laws of privacy and publicity,
certain communications statutes and regulations thereto and other applicable
laws, statutes and its rules and regulations. You alone are responsible for
your actions or the actions of any person using your user name and/or password.
You agree to defend, indemnify, and hold harmless, FIPS and/ or its associates,
subsidiaries, their owners, officers, employees, affiliates, licensees, business
partners and agents, from and against any claims, actions or demands, including
without limitation reasonable legal and accounting fees, alleging or resulting
from your use of GJS material or your breach of these Terms and Conditions.
Notice
All notices shall be in English and in writing and (a) if sent to the User to
the address identified on the Application Form and (b) if sent to the Company
to such address as provided in writing for such notice purposes; provided, however,
that all invoices and payments shall be sent to the attention of The Company?s
Finance department, all legal notices shall be sent to the attention of the
Company?s Legal Department, and all other correspondence shall be sent to the
attention of the account manager specified by the Company. Notice shall be deemed
given upon receipt when delivered personally and upon received acknowledgment
/ written verification of receipt from overnight courier and finally upon verification
of receipt of registered or certified mail. The services provided by the websites
maintained, operated or owned by FIPS (including Gulfjobseeker.com, and Datachampion.com)
do not extend to acting as an agent (express or implied) on behalf of any subscriber
or user. We have no agents and do not operate through any agents, except if
mentioned if any on our site.
Governing Law Jurisdiction
By accessing the Website you agree that the laws prevailing in India shall be
the governing laws in all matters relating to GJS as well as these Terms and
Conditions. Courts at Ahmedabad, Gujarat, India alone shall have the exclusive
jurisdiction in all matters relating to GJS and these Terms and Conditions,
irrespective of the territory and jurisdiction of your access to GJS. FIPS reserves
its rights to monitor all postings to the GJS. However, if FIPS becomes aware
of an inappropriate use of GJS or any of its Services, FIPS will respond in
any way that, in its sole discretion, FIPS deems appropriate. You acknowledge
that FIPS will have the right to report to law enforcement authorities any actions
that may be considered illegal, as well as any information it receives of such
illegal conduct. When requested, FIPS will co-operate fully with law enforcement
agencies in any investigation of alleged illegal activity on the Internet. FIPS

User Agreement
By creating an account on Gulfjobseeker.com, you agree to the following:
The resume/ insertion or information/data fed by the user can be updated by the
user or GJS alone, free of cost. FIPS/GJS shall not be responsible for any changes
made in the resume/information uploaded by the user. FIPS offers no guarantee
nor warranties that there would be a satisfactory response or any response at
all once the resume/ insertion or information/data is fed by the user. FIPS
neither guarantees nor offers any warranty about the credentials bonafides,
status or otherwise of the prospective employer/organization which downloads
the resume/ insertion or information/data and uses it to contact the user. FIPS
would not be held liable for loss of any data technical or otherwise, or of
the resume/ insertion or information/data or particulars supplied by user due
to acts of god as well as reasons beyond its control like corruption of data
or delay or failure to perform as a result of any cause(s) or conditions that
are beyond FIPS's reasonable control including but not limited to strikes, riots,
civil unrest, Govt. policies, tampering of data by unauthorized persons like
hackers, distributed denial of service attacks, virus attacks, war and natural
calamities. It shall be sole prerogative and responsibility of the user to check
the authenticity of all or any response received pursuant to the resume/ insertion
or information/data being fed into the network system of FIPS by the user, for
going out of station or in station for any job or interview. FIPS assumes no
responsibility in respect thereof and expressly disclaims any liability for
any act, deed or thing which the user may so do, pursuant to the receipt of
the response, if any, to the resume/ insertion or information/ date being fed
into the network system of FIPS. FIPS reserves its right to reject and delete
any resume/ insertion or information/data fed in by the user without assigning
any reason. This free service entitles the user alone i.e. the same person,
to add modify or change the data/information fed in by him but does not entitle
him to use the free service to feed fresh insertion or information/data /resume
of another person in place of the insertion or information/data already fed
in by such user. FIPS has the right to make all such modifications/editing/removing
details of resume and insert email id or mobile numbers or its company logo
in order to fit resume in its database or get responses from employers. The
username/password created by the subscriber will enable the subscriber to access
all the information received through GJS, but the sole responsibility of the
safe custody of the password shall be that of the subscriber and FIPS shall
not be responsible for data loss/theft of data/corruption of data or the wrong
usage/misuse of the password and any damage or leak of information and its consequential
usage by a third party. FIPS undertakes to take all reasonable precautions at
its end to ensure that there is no leakage/misuse of the password. All changes
/ modifications made by the user to the data / information shall be effected
and will come into operation only after 24-48 hours of such changes / modifications
being made. The user agreement between a user/subscriber and FIPS will be treated
as having been terminated in the following events: On completion of the term
for which the user/subscriber engages the services of the website; or In case
the user/subscriber violates any of the conditions of this agreement or any
other agreement entered into by him with FIPS, however, such termination will
be at the option and discretion of FIPS; or In writing and on such terms as
agreed to by the parties mutually. All data uploaded on GJS becomes the exclusive
property of FIPS and the user consents to the material being included in the
searchable database of GJS or any other ancillary website maintained by FIPS
and offering similar services. The User of these services does not claim any
copyright or other Intellectual Property Right over the data uploaded by him/her
on the website. Jurisdiction for any disputes arising from and related to this
contest shall be Ahmedabad, Gujarat, India to the exclusion of all other courts.
Disputes shall be resolved in accordance with the laws of India as applicable.
All data related to references used by job applicant in registration process
is at sole discretion of GJS / FIPS and by uploading the data related to references
jobseeker is authorizing GJS / FIPS to send acknowledgement E-mail to your references
for verification and also sending any other relevant information such as marketing
E-mail to the reference E-mail address. GJS / FIPS will respect any unsubscribe
request been sent from references added to its database. The User of these services
does not claim any copyright or other Intellectual Property Right over the data
uploaded by him/her on the website. Removal of CV Policy: Request for delete
CV registration will result into keeping the information intact in out database
and marking CV registration as blocked. Hence no employer can view your CV anymore.
You will not receive any emails from us in this case and if any email still
reaches you please opt for unsubscribe link. We keep all records of Registered
CV due to interconnectivity of CV database with our employer CV Database Access,
IP policies, user usage, CV application logs and other information added by
our team or consultants to keep monitoring our site usage and maintain proper
record keeping. If you still need to get all your information deleted, send
request to feedback (@) gulfjobseeker.com and we may considere it on case to
case basis. Registration Activation: GJS / FIPS holds right to ask verification
documents and forms to be filled up by its registered members in order to verify
their information by asking them to show documents and submit copies of the
same there fore to keep in its records. Registered members may be requested
to visit GJS / FIPS / FIMC office to complete this procedure before their Registration
can be activated. Registration Validity: All CV Registration on are valid only
for limited time and thereafter revalidation needs to be submited for activation
again with / without relevant documents.
CV Writing Service
Professional CV formats drafted by FIPS / FIMC / GJS are protected, and formally the property
of FIPS. Any kind of copying of format, matter, style, language, concept, confidential
matter and wording is prohibited and should not be duplicated / distributed
to others (except for your own use during your job hunting) without the prior
consent of FIPS / FIMC / GJS. CVs drafted by FIPS / FIMC / GJS do not guarantee
any kind of job and it is prepared on the base of instructions and matter detail
provided by you (as client), thereby FIPS / FIMC / GJS cannot be held responsible
for any damages arising out of it due to any reason, delay, non performance
or failure. All fees paid to in Advance / Full Payment are on Non Refundable
basis for service provided. FIPS / FIMC / GJS holds undisputed right to stop
the service at any given point of time due to dissatisfaction on inventory part,
overall Conduct / Behaviour of the client during the service / dealing. CV should
be collected / finalized within 30 days of time frame from your start date of
CV drafting process or else all the fee paid as advanced would be non refundable.
FIPS / GJS holds right to change the date of finalization within the set time
frame of 30 days. By using the service online and reading the above mentioned
matter you fully understand the terms & conditions of this service and accept
the same. Details provided to you in terms of use and any kind of breach of
this contract will result in a penalty/legal action against you (as client).
CV Distribution Service
FIPS / GJS / FIMC does not guarantee any kind of Job
placement in CV Distribution Service. Fees paid for this service advance or
full is non-refundable and nontransferable basis for service taken to market
your material digitially. Customer cannot make FIPS / FIMC / GJS responsible
in any manner, if after taking this service they did not found any Job or got
low Salary Offer from the market or Customer?s CV reached their own employer
/ company through CV Distribution service. Errors in content or subject or resume
or selection of category are not the responsibility of GJS / FIPS / FIMC once
it has been e-mailed in its database. GJS / FIPS / FIMC shall take an email
confirmation from its clients before forwarding their CV in its database. Once
the files or matter has been finalized and approved by the client, changes to
the same will not be entertained during or after the distribution process. Information
that is not supposed to be declared to Recruiters should not be submitted GJS
/ FIPS / FIMC. All responses received from distribution service shall be diverted
to GJS / FIPS / FIMC response center staff for verification and it will be notified
to its clients by email or messaging. GJS / FIPS / FIMC holds undisputed right
to remove your phone and email addresses and last employer name and your reference
details from your CV and cover letter in this service and replace it with its
own response center contact details. GJS / FIPS / FIMC can change the distribution
start date in this service due to any technical, subjective or other reasons.
Client should cooperate during our service procedure and will provide any necessary
documents or information, so that GJS / FIPS / FIMC can identify or verify your
credentials to provide distribution service in professional manner. GJS / FIPS
/ FIMC holds its right to cancel your order if it finds your behavior unacceptable
or due to any other technical or subjective nature it may feel right by refunding
service fees full or partial. Any delay in providing information or canceling
this service agreement within 30 days from date of signing, GJS / FIPS / FIMC
will deduct AED 200 towards cancellation and consulting charges and refund balance
amount by cheque. Any kind of claim or dispute related to this service agreement
should be brought up within 90 days of subscribing the service and thereafter
GJS / FIPS / FIMC will not accept any kind of claim or will not maintain records
of service. All customer requests should be sent to our email id feedback (@)
gulfjobseeker.com only. Any dispute on this service agreement will be settled
only in jurisdiction of Ahmedabad, Gujarat, India.
Employer Services
Use of Information/Data Supplied
The User hereby agrees and irrevocably authorizes
that the Company has the right to: Use for the companys own purpose, any data
or/and information supplied by the User in connection with this Agreement, and/or
pass on such information to any other associated companies or selected third
parties. Retain all data or/and information supplied by the User while using
the Service to remain at Gulfjobseeker.com for the exclusive use of the Company
in accordance with service agreement with the user, notwithstanding any termination
of the Agreement or suspension of the Service to the User herein. Anything contrary
to the above, unless specifically put down in writing, following the termination
or suspension of the Service to the User, all such data and information shall
remain in the Companys property, records and databases as the exclusive property
of the Company, for all times to come.
Confidentiality
The Receiving Party shall keep confidential and secret and not disclose to any
third party the Confidential Information nor any part of it, except to any of
the Receiving Partys Associates, if required and upon prior permission in
writing from the Disclosing Party. The Receiving Party agrees to take all
possible precautions with regard to protecting confidential information from any
third party and shall ensure that all its Associates to whom such disclosure
is made will act in accordance with the terms of this Agreement as if each of
them were a party to this Agreement, and if required obtain a written statement
from each of its employees/associates having access to such Proprietary
Information undertaking to abide by the confidentiality conditions.
All Proprietary Information shall be kept separate and exclusive
and at the usual place of business (or residence as the case may be) of the
Receiving Party.
Discontinuation or Modification to Services
The Company reserves the unilateral right to add to /and/or change and/or
delete and/or end the Service at anytime with or without notice to the User.
Except for paid service, a pro-rated refund shall be affected for the
remaining unused period. There shall be no liability on behalf of the
Company to the User or any third party in case the
Company exercise its unilateral right to modify or discontinue the Service.
Maintenance
The Company may at its sole discretion and without assigning any
reason whatsoever at any time deactivate or/and suspend the Use's access to
Gulfjobseeker.com and/or the Services (as the case may be) without notice to
carry out system maintenance or/and upgrading or/and testing or/and repairs
or/and other related work. Without prejudice to any other provisions of this
Agreement, the Company shall not be liable for any loss or/and damage or/and
costs or/and expense that the User may suffer or incur, and no fees or/and charges
payable by the User to the Company shall be deducted or refunded or rebated,
as a result of such deactivation or/and suspension.
Payment
Download Preview CV and Job Posting service is provided free of charges to all Employers.
For regular revisitor to Gulfjobseeker.com site FIPS may impose a pre agreed fees
as applicable and to be informed in prior to its clients in written or by email.
Users agree to indemnify and hold harmless GJS / FIPS / FIMC from any damages
or claims arising out of usage of their services or website for transmitting spam.

job seekers, employers or recruiters and do not tolerate spam and

you unsolicited emails. If you choose to give your name and email address into
one or more of our site's registration forms, then we will send you emails relating
to the mailing list(s) or service(s) you joined and the newsletter, as well

To fully participate in career support services, candidate databases or
search activities, we require you to register in Gulfjobseeker.com.
Non-registered users are granted partial participation
access e.g. non-registered job seekers may view positions posted but cannot

point in time, no employers or other members will have access to view or search
it through our search functionality. CVs with registration can be reactivated

ACTIVE again. This would enable any employer members who have paid to register
with our service to access your CV. We are not responsible for the privacy of
any copies of your CV or your contact information that are subsequently retained
by employer members in their own private files and databases. As an additional
privacy function, job seekers have the option to block the name of their current
employer from any CV been distributed by e-mail in employer database. You may
edit/change information on your CV at any point in time. You may also remove
/ deactivate your CVs from our databases at any point in time by sending us
an email.
Job Postings
Employers are asked to submit detailed contact information
and information about the position requirements as part of their job posting
activity. Information is submitted purely voluntarily or by our staff members.
Job details may be viewed by any registered job seeker or site visitor. Non-registered
site visitors may view position but cannot apply until they have registered
their details. As an additional privacy feature, employers may hide their company
name when their jobs are viewed online. Your privacy will thus be assured while
job seekers have the option to reply to the job posting. You may change/modify/delete

Job seekers and employers have access to a personal workspace from where they
can manage/document their job/candidate search history/ mark jobs/ mark CV confidential.
